FARM, OUTDOOR ACTIVITY & HIKING RELEASE OF LIABILITY, WAIVER OF CLAIMS, EXPRESS ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

AT HACIENDA DOMINGUEZ & CHELENZO FARMS

Summary

Here at Hacienda Dominguez & Chelenzo Farms we are proud to offer our guests access to 350 acres of private property where you can hike, explore and observe nature and wildlife. In addition to our land, our property borders nearly 3,000 acres of Bureau of Land Management (BLM) land, which is open to the public for recreational use. 

The majority of the land at Hacienda Dominguez & Chelenzo Farms is intentionally undeveloped for the sake of conservation and the opportunity for our guests to enjoy relaxation and recreation in a natural setting. 

However, there are risks inherent to activity on this land, including fragile landscapes, thorny plants and wildlife (including snakes, scorpions, rodents, coyotes, mountain lions, bobcats, bears and other animals; as well as cacti, agave, yucca, and russian olive trees). We ask that our guests be aware of their surroundings and take the necessary precautions not to attract and/or provoke wildlife, or accidentally incur injury from thorned or spiky desert vegetation, some of which have toxins that may lead to inflammation or allergic reactions. 

To help ensure the safety and wellbeing of you, your family and guests, we ask that you stay on the designated hiking trails created by the arroyos (gulleys) whenever traversing the land at Hacienda Dominguez & Chelenzo Farms. Any straying from these designated paths will be considered placing yourself in harm’s way and at your own risk. 

Please note that the pond on the property at the back of 48B Rainbow’s End is not intended for swimming or recreational bathing. For liability reasons and your safety, our guests and their pets are not permitted to swim in the pond. 

Guests are welcome to use the on-site hot tub located on the south-east side of the house. We require the safety cover be completely removed during use. While not in use, guests must place the safety cover in place on top of the hot tub. 

Hacienda Dominguez & Chelenzo Farms is an active farm, so we ask guests not to enter the garden areas without a staff member present. Guests are welcome to participate in pre-arranged farm activities, if and only if this waiver is signed by all guests involved.

Signing this waiver acknowledges that you understand the risks inherent to any of the aforementioned hiking and related activities; hot tub and pond; and farm operations. By signing this waiver and release form you agree to these and all the terms designated herein.

Anyone who refuses to sign a waiver prior to the activity may not participate. Nor may the individual alter or delete any language in the waiver.

Waivers cannot be signed by minors. Activity participants under 18 must have a waiver signed by a parent or legal guardian.
